I smell dozens of class-action lawsuits on the horizon, the
end result being that the MS EULA being ruled to be toothless
in all important respects (i.e. No, you can't sell a product with
advertising claiming that it does all these great things, and
then attach a EULA saying that the product is not fit to do
anything, as a way of denying legal and financial responsibility
for product defects; denial of basic consumer rights -- you
cannnot sign away your rights... for example, if you hire
someone to kill you, the contract is NOT legally binding --
no clause of any contract can legally allow one party to
commit crimes against the other, no matter how eagerly both
parties are to commit to the contract.)
