Unfortunately, these things are not hashed out on the "basics". The
Microsoft approach here in interesting....

1. Use the "stick" of FUD and threats of litigation if others don't
   come to the table.
2. Use the "carrot" of cooperation and immunity from litigation as
   the benefit of coming to terms.
3. Insert compatibility tools to expand the reach of an "embrace and
   extend" approach.

The first action drives off potential Linux customers and deprives
Linux distributors of what some may term "the high ground".

The second motivates many distributors to gain legitimacy and acceptance
in he broader market.

The third, probably the most dangerous, will create a fault line between
those who come  to agreements with MS, and those who don't.
