Misconceptions And FUD

• "Never tested in court"
  • Ruled valid in Germany
  • Everyone caves when the FSF comes calling
• Viral ("pot calling event horizon black")
  • No one is forced to use GPL code
  • You are free to reimplement, or pay the original author(s) for a special license
  • Just using GPL tools (gcc, Apache, etc.) does not force you to GPL your code
  • Just including GPL software with your software does not force you to GPL your code
  • Basically, the only time GPL comes up is when you'd be licensing code anyway
  • And all commercial licenses are vastly more restrictive
• Consideration
  • For a contract to be valid, there must be 'consideration'; something of value must exchange
  • But IP is a valid consideration
  • As is waiving the right to sue
  • "Your Honor, I ask that, since the asking price is (in my opinion) excessive, you rule in my favour and grant me the use of the copyrighted material for free."
